Part I

Terms of Service

1. Definitions

For the purposes of these terms, the following definitions apply:

Klaavi - an adaptive on-screen keyboard for Windows, software produced and distributed by Klaavi PSA.
Operator - Klaavi PSA, with its registered office in Warsaw, Aleja Jana Pawla II 27, 00-867 Warsaw, Poland, entered in the register of entrepreneurs of the National Court Register under number KRS 0001244751, NIP 5273221412, REGON 544568357.
User - a natural person, legal person or organisational unit without legal personality who downloads, installs or uses the Klaavi software.
FREE Plan - free, perpetual access to the basic set of Klaavi features, with no time limit.
PRO Plan - a paid annual subscription providing access to the full set of Klaavi features, excluding voice features.
Klaavi Voice - a paid annual subscription including all PRO features plus the voice module (text-to-speech and offline voice cloning).
PRO Trial - free 30-day access to the PRO Plan, activated after email address verification. One trial per device, regardless of the email address used.
Paddle - Paddle.com Market Limited, a company based in the United Kingdom, acting as merchant of record responsible for processing payments and issuing invoices to Users.
Account - a User profile identified by an email address and linked to an active licence or trial.
Hardware fingerprint - a device identifier generated locally from hardware parameters, used solely to limit the trial to one per device. Combined with an email address it may constitute personal data and is processed on the basis of legitimate interest.

The payment provider and the entity issuing invoices is Paddle.com Market Limited (United Kingdom). Klaavi PSA is not a party to the payment transaction with the User.

3. Scope of the service and accounts

Klaavi is desktop software for Windows, distributed as an installer downloaded from klaavi.app or the Microsoft Store. Klaavi PSA does not provide the service on a SaaS model. The software runs locally on the User's device.

A User account is created by providing an email address and clicking an activation link. The account does not require a password. One email address may be linked to one active subscription plan.

The FREE Plan is available without registering an account, either after the trial expires or by selecting "Start with FREE" in the application. The FREE Plan has no time limit and does not require payment details.

4. Subscription plans and trial

FREE Plan

The FREE Plan is free of charge and has no time limit. It includes the QWERTY layout with diacritics, a basic key panel with customisation options, right mouse button support, autoclick, keyboard transparency control and 3 dictionary suggestions without learning. Available with no time limit and no payment details required.

PRO Trial

After providing and verifying an email address, the User receives 30 days of access to the PRO Plan free of charge. The trial starts from the moment of email verification, not from the moment of software installation. One trial is available per device (verified by hardware fingerprint). Reinstalling the software on the same device or changing the email address does not grant a new trial. When the trial ends, Klaavi automatically switches to the FREE Plan. The software remains installed with no time limit.

PRO Plan

An annual subscription, renewed automatically unless the User cancels it before the renewal date. The PRO Plan includes all FREE features plus: 5 suggestions from an extended dictionary, an AI prediction engine that learns your writing style, the Phrase Panel, Ghost Mode, the ability to change the prediction language and keyboard layout, an additional fully customisable key panel and extended colour options. The subscription price is shown during the purchase process handled by Paddle. Current prices are available at klaavi.app.

Klaavi Voice

An annual subscription including all PRO features plus the voice module (text-to-speech and offline voice cloning). Available from month 13 after the Klaavi launch. Users with an active PRO Plan may upgrade to Klaavi Voice by paying only the price difference for the remainder of the current billing period.

5. Payments and payment provider

All payments for the PRO Plan and Klaavi Voice are handled by Paddle.com Market Limited as merchant of record. This means that:

The invoice is issued by Paddle, not by Klaavi PSA.
Paddle calculates and remits the taxes (VAT, GST and others) applicable in the User's country.
Payment card details are processed exclusively by Paddle and never reach Klaavi PSA servers.
Complaints concerning a payment transaction should be directed to Paddle at [email protected] or via paddle.com.

Subscription prices are expressed in PLN for the Polish market and in USD for other markets. Amounts include VAT or are shown exclusive of VAT, in accordance with the law of the User's country and as presented during the Paddle checkout process.

6. Refunds and cancellation

The refund policy is administered by Paddle as merchant of record in accordance with its terms. Users in the European Union have the right to withdraw from a distance contract within 14 days of the date the contract is concluded, unless they have consented to the immediate commencement of performance and have been informed of the loss of the right of withdrawal.

To request a refund, contact Paddle directly at [email protected] or via paddle.com. As merchant of record, Paddle is a party to the transaction and is responsible for handling refunds. Klaavi PSA can help escalate a matter to Paddle at the User's request.

A subscription may be cancelled at any time. Cancellation takes effect at the end of the current billing period. After cancellation, Klaavi switches automatically to the FREE Plan.

The right of withdrawal and the PRO Trial: Under the consumer protection rules applicable in the User's country (in Poland: Article 38(13) of the Consumer Rights Act; in the EU: Article 16(m) of Directive 2011/83/EU), the right of withdrawal does not apply to digital content and digital services where the consumer has consented to performance beginning before the withdrawal period expires and has been informed of the loss of that right. When activating the PRO Trial, the User gives that consent and acknowledges its consequences. A purchase of a PRO subscription after completing the full trial is an informed purchase, made after testing the full functionality of the product.

7. Email communication

By providing an email address to activate the trial, the User acknowledges that they will receive transactional emails necessary to operate the account and the subscription. These do not require separate consent and are sent on the basis of performance of the contract (Article 6(1)(b) GDPR). They include: the activation link, purchase confirmation, and information about trial and subscription expiry.

Informational and promotional email sequences (for example feature announcements and invitations to purchase PRO) are sent solely on the basis of separate consent given in the application or on klaavi.app. This consent may be withdrawn at any time by clicking the "Unsubscribe" link in any email or by writing to [email protected].

Transactional emails are sent regardless of marketing consent and cannot be opted out of while the account or subscription remains active.

8. Protection of minors

Klaavi is not intended for persons under 16 years of age. By using Klaavi and providing an email address, the User confirms that they are at least 16 years old or have the consent of a parent or legal guardian. Klaavi PSA reserves the right to delete the account and data of any person who does not meet this requirement, upon becoming aware of it.

9. Permitted and prohibited use

Klaavi is intended for personal and professional use as a writing assistance tool. The User may use Klaavi on any device for which they hold an active licence.

The following are prohibited:

reselling, sublicensing or otherwise making the software available to third parties without the consent of Klaavi PSA;
circumventing the licence, trial or hardware fingerprint verification mechanisms;
reverse engineering, decompiling or disassembling the software beyond the extent permitted by applicable law;
modifying the software and distributing modified versions;
using the software in a manner contrary to applicable law.

B2B licences (workstation packages) are assigned to a workstation and may be reassigned by the employer to a new employee in accordance with the terms of the B2B agreement concluded with Klaavi PSA.

10. Intellectual property

Klaavi and all of its elements, including the source code, user interface, icons, names, trade marks, the ML/ONNX prediction engine, language models and documentation, are the property of Klaavi PSA or its licensors and are protected by intellectual property law.

The KLAAVI trade mark is registered or filed for registration with the European Union Intellectual Property Office (EUIPO), application number 019353617. Use of the KLAAVI mark in a manner that may suggest an association with Klaavi PSA is not permitted without its consent.

These terms do not transfer any intellectual property rights in the software to the User. The User receives only the limited licence described in Part II of this document.

11. Limitation of liability

Klaavi is provided "as is". Klaavi PSA will make every effort to ensure that the software operates correctly, but does not guarantee uninterrupted or error-free operation.

To the maximum extent permitted by applicable law, Klaavi PSA is not liable for:

loss of data caused by malfunction of the software or the operating system;
interruptions in the availability of features that require an internet connection (activation, settings synchronisation);
indirect or consequential damages, or loss of profits.

The total liability of Klaavi PSA towards the User shall not exceed the amount paid by the User for the subscription in the 12 months preceding the event giving rise to liability.

This limitation does not exclude the liability of Klaavi PSA arising from mandatory provisions of law, in particular consumer protection law.

12. Changes to the service and these terms

Klaavi PSA reserves the right to make changes to the software, the range of plans and these terms. We will inform Users of material changes to these terms by email or by a notice in the application at least 14 days before they take effect.

If the User does not accept the changes within that period and does not cancel their subscription, the changes take effect at the beginning of the next billing period. A User who is a consumer retains the right to cancel their subscription before the changes take effect, at no additional cost.

13. Governing law and disputes

These terms are governed by Polish law. Any disputes arising from these terms or from the use of Klaavi shall be settled by the courts having jurisdiction over the registered office of Klaavi PSA, subject to the consumer rights arising from the mandatory provisions of the law of the User's country of residence.

Nothing in these terms deprives a User who is a consumer of the protection afforded by the mandatory provisions of the law of the country in which they habitually reside.

Users who are consumers in the European Union may use the Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.

Matters not covered by these terms are governed by the provisions of the Polish Civil Code, the Consumer Rights Act and other acts of Polish and EU law.

Part II

End User Licence Agreement (EULA)

E1. Grant of licence

Klaavi PSA grants the User a non-exclusive, limited licence to install and use the Klaavi software on Windows devices in accordance with the plan purchased, subject to the mandatory provisions of the law of the User's country concerning software distribution:

FREE Plan - one device.
PRO Plan and Klaavi Voice - up to two devices linked to the same account (email address).
B2B licence (workstation package) - one workstation, assigned to that workstation in accordance with the B2B agreement concluded with Klaavi PSA.

The licence is valid for the duration of an active subscription (PRO or Voice), or perpetually in respect of the features of the FREE Plan.

E2. Licence restrictions

The licence does not include the right to:

copy the software, other than making a backup copy for personal use;
decompile, disassemble or reverse engineer the software, except to the extent permitted by the mandatory provisions of the law applicable in the User's country (in particular provisions on software interoperability);
modify or translate the software, or create derivative works;
rent, lease, lend or sublicense the software;
remove copyright notices or licence information from the software.

E3. Trial and activation

The PRO Trial is activated once, after email address verification. The device hardware fingerprint is recorded at the moment the trial is activated. Any attempt to circumvent the one-trial-per-device mechanism (by changing the email address, reinstalling the operating system or by other technical means) constitutes a breach of the licence terms.

The email activation link is valid for at least 12 months from the date it is sent. Klaavi PSA will make every effort to keep links valid for the entire period the product is active. Verification may be carried out at any time after the software is installed.

Activating a PRO or Voice subscription requires an internet connection in order to verify the licence. Once activated, Klaavi operates fully offline. No internet connection is required to use the product features.

E4. Features covered by the PRO and Voice licence

The current list of features available in each plan is published at klaavi.app and may be extended with new versions of the software. Klaavi PSA reserves the right to add new features to higher plans without any obligation to make them available in the FREE Plan.

Features available exclusively in the PRO Plan and Klaavi Voice, and hidden or locked in the FREE Plan, include among others: 5 predictive suggestions with learning, an extended dictionary powered by the AI engine, the Phrase Panel, Ghost Mode, the ability to change the prediction language and keyboard layout, an additional fully customisable key panel and extended colour themes. In the FREE Plan, locked PRO features are marked visually in the application interface.

If a PRO or Voice subscription expires, the software switches automatically to the FREE Plan. The User's local data (prediction personalisation, Phrase Panel, statistics) is retained and remains available if the User later returns to the PRO or Voice Plan.

E5. Local data and privacy

Klaavi processes data relating to the User's typing (words typed, writing patterns, phrases) exclusively on the User's device. This data is not transmitted to Klaavi PSA servers or to any third party.

The ML/ONNX prediction engine runs entirely offline. Klaavi does not require internet access for its prediction and personalisation features to work.

E6. Software updates

Klaavi PSA may release software updates containing bug fixes, feature improvements and new capabilities. Updates are available through the automatic mechanism built into the application or by downloading the installer again from klaavi.app.

Installing an update may be required in order to maintain compatibility with an active licence or to access new features. Klaavi PSA is not obliged to maintain older versions of the software.

E7. Termination of the licence

The licence terminates automatically if the User breaches the terms of this document. Upon termination of the licence, the User must stop using the PRO or Voice features and may continue using the FREE Plan only, or uninstall the software.

Uninstalling the software deletes local data (personalisation, statistics, phrase panel) from the device. This data is not restored after reinstallation unless the User has backed up their local Klaavi profile.

E8. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Klaavi software is provided without any warranties, express or implied, including any warranty of fitness for a particular purpose or non-infringement of third-party rights.

This disclaimer does not affect the rights available to consumers under the mandatory provisions of Polish and EU consumer protection law.
